1 Introduction
We may revise these terms and conditions at any time by updating this page. You should check the website from time to time to review the current terms and conditions, because they are binding to you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms listed on particular pages of this website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this website.
2 Ordering from us
2.1 You are deemed to place an order with us by ordering via our online checkout progress. As part of our checkout process you will be given the opportunity to change your order and to correct any errors. We will send you an order acknowledgement detailing the products you have ordered.
2.2 Our acceptance of any order takes place when we despatch the order.
2.3 We may refuse to accept an order:
When goods are not available
Where we cannot obtain authorisation for your payment
If there has been a pricing or product description error
If you do not meet any eligibility criteria set out in our terms and conditions
2.4 Any turf specifications, formulations, data, literature and statements as to seed content, seed weight, seed ratio, grass ratios, seed and grass species, suitability, performance or therwise, issued and descriptions and samples given by us in connection with turf are offered in good faith but are intended to be approximate only and shall not constitute representations nor shall they become warranties or conditions of the contract.
3 Price
3.1 All total delivered prices will be calculated with VAT (where applicable) at the current rates in the United Kingdom. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and in the total price.
3.2 Unless otherwise stated, the price is exclusive of any delivery charge and this delivery charge shall be set out on the website.
3.3 Lawns and Gardens reserves the right to increase prices of any items displayed for sale on the website and/or delivery charge from time to time. However, where the price of goods and/or delivery changes between order and delivery, the price and/or charge will be displayed on the order form.
4 Payment
4.1 Payment can be made by credit or debit card. We do not accept American Express.
4.2 The amount payable by you shall be the total price of the goods and delivery charges. The acknowledgement of order e-mail set out as referred to in clause 2.1 will confirm price payable by you.
5 Availability and Delivery
5.1 If there are any problems with your order Lawns and Gardens will contact you by telephone.
5.2 All products supplied by Lawns and Gardens are supplied with no guarantee unless stated otherwise.
5.3 Lawns and Gardens reserves the right to refund your payment in the event that the turf or related products ordered by you are unavailable.
5.4 Responsibility cannot be accepted for damage caused by our vehicles leaving the highway at the customers request.
6 Cancellation, returns and Non-Deliveries
6.1 If you wish to cancel your order you can notify us by telephone on 01628 636949 or e-mail sales@lawnsandgardens.org before we have despatched the good to you.
6.2 Once turf is harvested you cannot cancel your order as turf is a perishable product and deteriorates quickly once harvested. Notice required will be by 12 noon the day prior to your delivery.
6.3 Any other product sold through Lawns and Gardens other than turf can be returned within 30 days of receiving goods :
6.3.1 Goods must be returned to Lawns and Gardens, complete, unused and undamaged. We shall not receive goods back due to ‘over ordering or miscalculation on your part’.
6.3.2 Goods must be returned to Lawns and Gardens at your own expense.
6.3.3 Lawns and Gardens will repay any sums paid by you for the goods within 30 days of receiving
the goods back.
6.4 If you wish to return the goods because they do not comply with these conditions, any of your statutory rights, or where Lawns and Gardens has not supplied the correct goods, you should contact Lawns and Gardens by the details set out in clause 6.1 within 30 days of discovering the fault or error. If you agree to return the goods at Lawns and Gardens expense you have the right to ask Lawns and Gardens to send you replacement goods, or repay any sums paid by you.
6.4.1 If packaging has been damaged in transit but the goods have not then your rights under clause 6.4 do not arise.
6.5 Please be aware as stated in clause 6.2 that turf is a highly perishable product and if not laid promptly as recommended by Lawns and Gardens may deteriorate rapidly. Lawns and Gardens advises that turf is to be laid within 12 hours of receiving delivery. Lawns and Gardens will not accept responsibility for deterioration. It is your responsibility to ensure that you are able to lay turf before agreeing to the delivery date.
6.6 Please be aware that the condition of turf supplied by Lawns and Gardens will be dependent on factors beyond Lawns and Gardens control; this includes weather conditions and other such factors. It is your responsibility to care for the turf once it has been delivered. Lawns and Gardens is available for advice, but will not take responsibility. You will not be able to return turf because of faults arising after delivery, whether this is due to your failure to care for the turf or due to external factors.
6.7 The title of the goods is not passed until payment is received in full.
7 Liability
7.1 We, any other party (whether or not involved in creating, producing, maintaining or delivering this website), and any of our group companies and the officers, directors, employees, or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party ( including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort ( including without limitation negligence, contract or over wise) in connection with this website, any websites linked to this website or the material on such websites, including but not limited to loss or damage due to viruses that may infect computer equipment, software date or other property on account of your access to, use of, or browsing this website or your downloading of any material from this website or any websites linked to this website.
7.2 If your use of material on this website results in the need for servicing, repair or correction of equipment, software or date, you assume costs thereafter.
7.3 You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs, (including reasonable legal fees) arising out of any breach of the Terms and Conditions by you, or your use of this website or the use by any other person using your registration details.
7.4 Lawns and Gardens cannot be held responsible for any failure to deliver goods due to anything that is beyond its reasonable control including but not limited to fires, explosions, severe weather, industrial disputes, insurrection, riots, embargoes, delays in transportation, war (whether declared or not), civil unrest, terrorist action or breakdowns.
8 Miscellaneous
8.1 These Terms and Conditions shall be governed by and construed in accordance with English Law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English Courts.
8.2 You will agree with Lawns and Gardens that any agreement made under these Conditions is between you and Lawns and Gardens and is not intended to be enforceable by any other person who is not party to it. |
